John D. Cerqueira v. American Airlines

---F.3d ----, 2008 WL 541642 (1st Cir. 2008)

The NAACP filed an amicus brief in support of plaintiff-appellee, asserting that district court correctly understood that airlines must harmonize their safety policies with existing civil rights and agency laws, to ensure that airlines rely on accurate information when making passenger removal decisions, rather than on the type of racially biased misinformation that history reveals to be untrustworthy.  The NAACP joined Lawyers’ Committee for Civil Rights Under Law, Asian American Justice Center, Mexican American Legal Defense & Educational Fund and Puerto Rican Legal Defense Fund on the brief.

On January 10, 2008, the U.S. Court of Appeals for the First Circuit reversed the district court’s judgment and remanded the case to the district court with instructions to vacate the judgment and fee award in favor of John D. Cerqueira and enter judgment for American Airlines, Inc.
