The NAACP filed an amicus brief in support of respondent's arguments that the U.S. Court of Appeals for the Ninth Circuit properly held that four physician shareholders, who actively perform medical services, are employees. Accordingly, NAACP asserts that petitioner the Clackamas Gastroenterology group is large enough to be deemed an employer under the Americans with Disabilities Act of 1990 (ADA). See 42 U.S.C. § 12111(5)(A). The NAACP joined the Lawyers' Committee for Civil Rights, AARP, AALDEF, NAPALC, National Partnership of Women & Families and PRLDEF on the brief.
