In this case, an African-American employee complained of offensive racist remarks by other employees and was fired.  The 4th Circuit did not agree that the employee engaged in protected conduct in violation of Section 704(a), which protects and employee against retaliation.  The NAACP argued that the employee had engaged in protected conduct.  The NAACP joined the National Employment Lawyers Association, Equal Rights Advocates and the National Disability Rights Network on the brief.
