State of Connecticut v. Spellings, Secretary of Department of Education

U.S. District Court Connecticut, No. 3:05-CV-01330 (MRK) (2006)

The State of Connecticut sued the U.S. Department of Education on grounds that the "No Child Left Behind Law" (NCLB) is an unfunded mandate, and argued that the State should not be forced to comply with certain testing requirements under NCLB. The NAACP, through its Connecticut State Conference, filed a motion to intervene on behalf of African American (and other) children whose interests were not being adequately protected by any party. John Brittain, Jr. and Erika Woods of the Lawyers Committee for Civil Rights Under Law, William Taylor and Dianne Piche of the Citizens' Commission on Civil Rights, James d'Auguste and Sarah Baumgartel of Akin, Gump, Strauss, Hauer & Feld and the NAACP Legal Department represent the State Conference.
