Connecticut v. Spellings, Secretary, United States Department of Education (2006)

On January 30, 2006 the Connecticut State Conference of NAACP Branches filed a motion to intervene in a federal case where the State of Connecticut sued Margaret Spellings, in her capacity as Secretary of the U.S. Department of Education. The Connecticut suit challenges certain provisions of the No Child Left Behind Act and requests the Court to exempt the State from complying with a number of provisions under the Act. In particular, the State of Connecticut contends that NCLB's testing requirements are an "unfunded mandate" and that the U.S. Department of Education should have granted Connecticut waivers which would have exempted the State from complying with certain NCLB provisions related to testing. Intervenors are represented by the NAACP Legal Department.
