African-American voters and organizations, including the NAACP, brought an action under the Voting Rights Act claiming that a state redistricting plan had the effect of denying black voters equal opportunity to elect state senate candidates of their choice. The United States District Court for the District of Rhode Island, Ernest C. Torres, Chief Judge dismissed the complaint and plaintiffs appealed. On rehearing en banc, the Court of Appeals held that action could not be resolved at the motion to dismiss phase. The District Court decision was vacated and remanded. In September 2004, Harold Metts, the lead plaintiff and the minority candidate, was elected to the Rhode Island Senate.
