The Court ordered the City to supplement the Consent Decree in a attempt to resolve differences about the validity of the physical ability examination for fire fighters without the need for further contested litigation. The parties agreed to administer the same or similar physical ability examination for the selection of fire fighters in the next examination process as it did in 2001, and to make a public announcement about the test in advance to allow interested candidates who still meet qualifications to become fire fighters, but did not pass the timed portion of the physical ability examination administered in 2001, to reapply and participate in the training program.
